What is Fair Use?

Fair Use is a legal principle that allows limited use of copyrighted material without needing permission from the copyright owner. It applies when the use is for specific purposes such as commentary, education, criticism, parody, or news reporting.

Fair Use does not mean that anything can be used freely. Instead, it provides a narrow exception based on how the material is used and whether it transforms the original intent.

Four Key Fair Use Factors

• Purpose of use: Noncommercial, educational, or transformative uses are more likely to qualify.
• Nature of original work: Non-fiction allows more flexibility than creative works like music or films.
• Amount used: Using small or less significant parts supports Fair Use.
• Market impact: If your use harms the original creator’s income, it's less likely to qualify.

Common Fair Use Examples

• Reaction videos that add commentary.
• Parodies that transform the meaning of the original work.

Limitations of Fair Use
